Imam Khomeini, as one of the great scholars and authorities in Islamic jurisprudence and law, has given special attention to the importance of social justice. Imam Khomeini's views on social justice include: The Primacy of Justice: Imam Khomeini emphasized the primacy of justice, introducing it as a fundamental and essential pillar in Islamic jurisprudence and law. Distribution of Resources: Imam Khomeini stressed the fair distribution of resources and wealth in society, highlighting the importance of this issue for maintaining social justice. Social Equality: Imam Khomeini promoted social equality and the observance of the rights of all individuals in society, considering this as one of the important Islamic principles. Combating Oppression and Inequality: Imam Khomeini emphasized the fight against all forms of oppression and social inequality, advocating for a just and equal society. Social justice in Islamic jurisprudence and law plays a crucial role in determining the rights and duties of individuals and the distribution of resources and wealth. Adhering to the principles of social justice strengthens public trust and solidifies society. Following the teachings of social justice contributes to the economic and social development and progress of society. Therefore, in Islamic jurisprudence and law, the role of social justice is highly critical, and emphasizing it as a fundamental principle is of great importance, which Imam Khomeini also followed for the structure and development of society. This study attempts to examine the role of social justice in jurisprudence and law with an emphasis on Imam Khomeini's views using a descriptive and explanatory method.</p> <p>در فقه و حقوق اسلامی، عدالت اجتماعی به عنوان یک اصل اساسی و حیاتی تلقی می‌شود که تأکید بر آن در تشریعات و احکام اسلامی بسیار مهم است. امام خمینی (ره) نیز به عنوان یکی از بزرگان و مرجعان فقه و حقوق اسلامی، به اهمیت عدالت اجتماعی توجه ویژه‌ای داشته‌اند. نظرات امام خمینی (ره) درباره عدالت اجتماعی عبارتند از: الف. اصالت عدالت: امام خمینی (ره) با تأکید بر اصلیت عدالت، آن را به عنوان ستون اصلی و اساسی در فقه و حقوق اسلامی معرفی کرده‌اند. ب. توزیع منابع: امام خمینی (ره) بر توزیع عادلانه منابع و ثروت‌ها در جامعه تأکید داشته‌اند و اهمیت این مسئله را برای حفظ عدالت اجتماعی بیان کرده‌اند. ج. برابری اجتماعی: امام خمینی (ره) به ترویج مساوات اجتماعی و رعایت حقوق همه افراد در جامعه پرداخته و این امر را به عنوان یکی از اصول اسلامی مهم برشمرده‌اند. د. مبارزه با ظلم و نابرابری: امام خمینی (ره) به مبارزه با هرگونه ظلم و نابرابری اجتماعی تأکید کرده و از جامعه عدالتمند و برابر خواستار بوده‌اند. عدالت اجتماعی در فقه و حقوق اسلامی نقش بسیار مهمی در تعیین حقوق و وظایف افراد و توزیع منابع و ثروت‌ها دارد. احترام به اصول عدالت اجتماعی، باعث تقویت اعتماد عمومی و استحکام جامعه می‌شود. پیروی از آموزه‌های عدالت اجتماعی، به توسعه و پیشرفت اقتصادی و اجتماعی جامعه کمک می‌کند. بنابراین، در فقه و حقوق اسلامی، نقش عدالت اجتماعی بسیار حیاتی است و تأکید بر آن، به عنوان یک اصل اساسی، از اهمیت ویژه‌ای برخوردار است که امام خمینی (ره) نیز از اهمیت این اصل برای ساختار و توسعه جامعه پیروی کرده‌اند. در این پژوهش سعی شده است نقش عدالت اجتماعی در فقه و حقوق با رویکردی بر نظرات امام خمینی (ره) به روش توصیفی و تبیینی مورد بررسی قرارگیرد.</p> https://journalspsich.com/index.php/journalspsich/article/download/174/129
