In the Islamic Republic of Iran and the United States of America, this issue has been emphasized in different ways in the constitution. The upcoming research deals with a comparative study between the separation of powers in these two countries. At the beginning, different models of the separation of powers are discussed, then the relations between the executive and legislative powers and the separation of powers beyond the two powers are examined. The result is that in America there is separation of powers of the type of presidential system, but none of the models of separation of powers have been implemented in Iran.</p> </div> <div class="padding_abstract justify rtl" style="box-sizing: border-box; direction: rtl; text-align: justify; padding: 15px; border-left: 0px !important; border-right: 5px solid rgba(0, 0, 0, 0.1) !important; color: #333333; font-family: rtl-font, Arial, Helvetica, sans-serif; font-size: 14px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; background-color: #ffffff; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;">تفکیک قوا یکی از موضوعات مهم در حوزه حقوق اساسی کشورهای جهان است. در جمهوری اسلامی ایران و ایالات متحده آمریکا نیز این موضوع به طرق مختلف در قانون اساسی مورد تأکید قرار گرفته است. پژوهش پیش رو به مطالعه تطبیقی میان تفکیک قوا در این دو کشور می‌پردازد. درآغاز مدلهای گوناگون تفکیک قوا بحث و بررسی می‌شوند، سپس روابط میان قوای مجریه و مقننه و تقکیک قوا در فراتر از دو قوه مورد بررسی قرار می‌گیرند. نتیجه آنکه در آمریکا تفکیک قوا از جنس نظام ریاستی وجود دارد، اما در ایران هیچ یک از مدل‌های تفکیک قوا پیاده سازی نشده اند.</div> https://journalspsich.com/index.php/journalspsich/article/download/18/7
