This access has taken the form of a legal institution known as "amicus curiae," where an amicus curiae is a natural or legal person who is not a party to the dispute but submits written or oral statements regarding the facts and rules governing the dispute at their own initiative or at the court's request. A review of judicial practice shows that the major players in this field are international non-governmental organizations, although their participation in the dispute resolution process has faced many obstacles and challenges. This research aims to explain the role of international non-governmental organizations and examine the consequences of their presence, including significant impacts such as combating impunity, achieving judicial transparency, democratizing international law, and ensuring fair trials.</p> </div> <div class="padding_abstract justify rtl" style="box-sizing: border-box; direction: rtl; text-align: justify; padding: 15px; border-left: 0px !important; border-right: 5px solid rgba(0, 0, 0, 0.1) !important; color: #333333; font-family: rtl-font, Arial, Helvetica, sans-serif; font-size: 14px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; background-color: #ffffff; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;">سازمان های بین المللی غیردولتی که هدف و محوریت اصلی کارکرد آن ها تامین منفعت عام است در همین راستا توانستند پس از فراز ونشیب های زیادی که طی کردند ، به مراجع بین المللی جهت دستیابی به این مهم راه یابند . این راه یابی درقالب نهاد حقوقی تحت عنوان ، دوست دادگاه رخ داد که دراین مفهوم، یاور دادگاه شخصی حقیقی یا حقوقی است که طرف دعوا محسوب نمی شود و به ابتکار خود یا به درخواست دادگاه اظهارات خود را در خصوص وقایع و قواعد حاکم بر دعوی به صورت مکتوب یا شفاهی به دادگاه تقدیم می کند . بررسی رویه قضایی نشان می دهد بازیگر عمده این عرصه ، سازمان های بین المللی غیردولتی اند که البته مشارکت آن ها در فرایند حل و فصل اختلافات با موانع و چالش های فراوان همراه بوده است . این پژوهش به دنبال تبیین نقش سازمان های بین المللی غیردولتی به عنوان و بررسی پیامدهای حاصل از این حضور است ، از جمله رهیافت تاثیرگذار این تاسیس ، مبارزه با بی کیفر مانی ، دستیابی به شفافیت قضایی ، دموکراتیک شدن حقوق بین الملل و تحقق دادرسی عادلانه است.</div> https://journalspsich.com/index.php/journalspsich/article/download/72/59
